Initially, you and the property manager would have come to an agreement about who retains the security deposit. This would be in writing in your property management agreement. Check your agreement. Did you get a business accounting of the funds in and expenses out for the rental period? It should be clear to both parties. You should receive it monthly from the property manager.
Damages and unpaid rent are another issue. There is most likely a clause in your property management agreement that holds the property manager harmless for damage that tenants do to your rental property. For unpaid back rent, did you talk to the property manager when it occurred and recurred? Did you two discuss starting the eviction? Since the problems are complicated, the answers probably also are complicated. You CAN file a small claims suit against the property manager and the tenants. Who knows how it will resolve?
