Thanks, I agree that it is not fair to the tenant but they are the ones who want to do it this way. I would never had suggested this to them.

I like your idea for the 1/1 start date. But I'm leery of writing up any sections myself for fear that it might make the whole lease illegal or something and come back to bite me later. I was hoping there was actually a legal form template already out there that had language like this.

Update! I am listening to your initial advice that there will always be renters and we should just wait. I emailed my prospects and told them no, that we would not have them sign a lease now.
I told them that I will keep their name on a list of interested prospects (I actually do have a list!) and let them know when we're ready to rent.
Thank you so much for talking some sense into me.
