Re: Evicting Threatening Tenant - Landlord Forum thread 323069

Re: Evicting Threatening Tenant by Heather (Iowa) on August 19, 2014 @11:36

We called the police. Unfortunately, they refused to do a report. At least the call is on record for them coming out. The tenant admitted that he threatened my husband and felt he was justified, but with the police refusing to do the report, I don't know how much help they will be. I even called the supervisor to try to get him to make the responding officer do the report, and they wouldn't do it. My husband had our 15 year old son with him, but I understand that's not great proof. I happened to call my husband during the issue, and I heard the man screaming at him, but I couldn't make out the words. I'm hoping they're just acting like this because they discovered they didn't like the house they've been bothering us about since they moved into the other house we rented them and will get out. I don't know why I didn't pick up on this before, but it doesn't seem to be their first rodeo.

The witness testimony is apparently done by affidavit at the hearing, so I'm going to have my son do an affidavit, and I'll do one. But like I said, I can't say I heard the threat, but I did hear screaming and yelling.

I'm so freaked out about this that even my dog isn't sleeping. I'm not joking about that. Thank you so much for the advice. Don't worry, we've come to our senses and realized that we are not people that are equipped to participate in property investment. We'll be selling our property.

"The witness testimony is apparently done by affidavit at the hearing, so I'm going to have my son do an affidavit, and I'll do one."

Your son is a poor witness because he's your minor child. He'll say exactly what you tell him to say. You're a poor witness because you weren't even there, and 'heard yelling over the phone' is no good either. How do you know you didn't just hear a loud television?

"I'm so freaked out about this that even my dog isn't sleeping."

Please, for Christ's sake, do what you have to do and don't get upset about this. Also, turn down the drama.
