It's not any kind of an eviction. "If a landlord refuses to let you move in after she has taken money from you or has signed an agreement saying she will rent the apartment to you, the landlord may not be able to back out of the deal." This quote is taken from MassLegalHelp. But you have not given the landlord any money nor have you signed a lease. So, it's NOT an eviction, much less an illegal one.
