You have a SECURITY DEPOSIT. You do NOT have RENT. He cannot occupy the apartment until the RENT is paid. I hope you haven't given him a key.
Also NEVER sign the lease until the moment the tenant is ready to move in and you have EVERYTHING (security, 1st and last, pet deposit, whatever). DO not sign it the day before. Sign on the day you hand over the key to give the tenant OCCUPANCY and you are absolutely sure everything is good.
This way if there is one thing out of place, you can say, "NO" and without a signed contract by both parties, you can back out.
I've had to do this twice in my 10 years and there's not a damn thing the other party can do about it. And I am SO GLAD I did it that way.
No RENT = No OCCUPANCY.

I understand that, anonymous. We frequently sign leases well in advance of the move-in date. It's never been a problem and isn't now.
I was mentioning this because it's somewhat unique.
If he doesn't pay rent, I have his $500. In this market (Denver), apartments rent in a few days - if that. I don't care if he ever pays rent.

I don't understand why you wrote, "I will be in touch with my eviction attorney tomorrow."
So if you understand, you would know this is not an eviction and no attorney is needed. You just simply don't allow the person to move in.

It's still a contract, and contains a questionable clause written by me. I always get legal advice in tricky situations.
