Over the weekend our tenants moved without notice and of course without payment. Their lease is thru Nove 14th of 2014. Along with nonpayment of rent they also left approx 780.00 of unpaid utilities. I am wondering what we are allowed to do legally. We also believe they have changed the locks on the doors and did not leave keys.

In Florida, if the rent is not paid, you can take possession under the assumption the property is abandoned after two (2) weeks.

Post your Pay or Quit, any follow up notices along with a Notice of Property Abandonment then wait your state's time requirement and it's yours. Check your state statutes for abandonment.

While you're waiting, there is nothing keeping you from entering the property for inspection as long as you provide the required notice posted to the door. What you do while you're in there is your business. It's possible the place could be ready to show the day your take possession.

As for the utilities, if you put the utilities in your name, let that be a lesson to you. Don't do it again. If not, what are you worried about?

Immediately post a "quit or pay" notice on the front door. Also, mail it certified mail. (When you get it back...do not open it...it is your proof you mailed it)

When the rent remains unpaid for the period of time required by your state law...go file for eviction. You need a judge to return possession of the unit to you...you cannot just enter and take over the place.

Once you have the eviction...go fix the place up, and file in small claims for the total amount of your out of pocket. (Lost rent for Sept and Oct ..[.no notice]. new locks ...[tenant didnt return them]. Damages, cleaning, and legal costs.). Don't change the locks until the eviction is in your hand. Then..do not just get new keys....change the locks

Always check YOUR state's statutes before acting on the opinions of other LLs on this site.

In my state, Florida, you can take possession WITHOUT filing for eviction if the tenant has abandoned the property after two weeks and the rent is not current.
