In California

I have an applicant that is still married but is separated from the spouse.

Technically, the spouse can move into the apartment, so I had both fill out the application.

If I approve them, should I have both applicants sign the lease or is it enough to have the 1 perspective occupant sign?

No matter who signs you are going to have two tenants. So, get them both to sign if both completed the application. If both are not approved individually you should consider other applicants.

Another thing, when they both move in, one or the other will be moving out and asking you to "remove" them from the lease. Do not do it. Watch out for the "wife" to move out and the girlfriend to move in during the lease.

I'm in CA and I have not heard that the new spouse has the right to move into your property without passing your screening. I think you are incorrect. Please cite your source for this.

What do you mean by "separation"? Is this a legal separation or just they aren't living together?
