Our tennats that we had to bring to court to get evicted are finally leaving. We have a $1000.00 security deposit. I want to walk through the apartment with my contractor and get an estimate for any work that needs to be done above and beyond wear and tear within a few days after they have left.
Tenant is insisting that he wants to be there for the walk through. Is this legal after they have given us the keys back? I prefer he is not there as the whole situation has been very stressful.

The tenant was already evicted and has no right to be there.

Just do it without involving the tenant in any way. If you must speak with the tenant, tell them that their deposit settlement statement and security (if any is left) will be forwarded to their forwarding address)

Your tenant has been evicted and is to no longer be allowed on your property. Stop communicating with this tenant. He is not allowed back on your property.

If you can not avoid your tenant's calls, you can say that your lawyer has advised you not to talk to him again and then hang up.

Hopefully you have changed the locks by this time. If not, do it immediately. Do not cut the tenant any slack. Photograph and charge for absolutely every little thing you find plus cleaning and restoring the lawn is applicable.

how can he "insist" ... just set it up with your contractor and keep the EXtenant out of your timing discussions.

If the tenant was evicted he obviously owes you rent in addition to restoring the property. How could he possibly believe he will get his deposit refunded in any amount?

If your tenant calls again you should inform him that the walk through has already been conducted and he will be notified of the results in the security deposit settlement statement.
