How do you know this tenant did it? If the landlord winds up defending this and looses, the landlord would be on the hook for tenants lawyer and court cost which would be more than just removing some straws. Common sense would rule in this case. Why would you take the chance? Some states double and triple the amount wrongly witheld by the landlord. Again how would a landlord prove it?

    She lived there for 14 years and was not a nice tenant to me or others who lived there (everyone living there is doing the happy dance now that she is gone). The straws were too new looking to be there from someone else. She did not like me or others so I was not be surprised she did this. She only paid $200 for a deposit because it was another owner when she moved in and that was all he took from her. She also left behind many items in every single room as well as a filthy place (stove/oven will be thrown out for it was totally disgusting). I will be sending a bill but not sure I will charge for this clog.

      It looks like you are going to run out of deposit way before you get to the clog.

      I'd charge (if Mass let LLs charge for their own labor). If the tenant took me to court to get the deposit back and the judge questioned this one, I'd say the straws were too meticulously place to be there by accident. Also, I'd point out that the tenant never reported the slow draining, as is a tenants responsibility,and even though she reported everything else under the sun.

Tenants are far too lazy to take anyone to court and if they do, who cares!? Stop living in such a common state of fear and use common sense! If the ll has to take the plumbing apart-CHARGE FOR IT!
