my contractor screwed me over and the building has no water pressure for a day because the plumber disconnected the well pump to do work and never reconnected it. now the tenants want it taken out of their rent because the contractor lied to me. do i really have to pay them when they are missing water for a day or two? this seems like it should be 75% the tenants fault for being unprepared. whats the minimum i should give them? 1/30th of the rent since its 1 day?

This was in NO WAY the tenants fault. It is completely unreasonable for the tenants to be expected to prepare for the landlord failing to provide the REQUIRED minimum defined under the warrant of habitability (google it if you are unfamiliar with the concept)

Give them all a rent discount for each day they had no water..and apologize profusely

Why is this the tenants fault. They had no say so in the repairs you had done. You are the one who hired the contractor. Good grief, its never the landlords fault, blame it on the tenants.

IF this is really not just a troll post...

How in the world do you expect tenants to store enough water to drink, cook, wash dishes and flush for a full day or two?? Yes, give them a rebate and apilogize profusely.

There are a couple of problems in this post.

1. Whenever repair work is done on my property i'm pretty involved. So I want to see the work. I want to see the work after. I want to see the results. So my suspicion is you weren't involved in the work.... I always stay on-site during the repair....

2. I would have posted something for the tenants explaining work being done and the possibility of no water... I would have provided some remediation in the event (i.e. a few gallons of water per unit "just-in-case").

3. Unfortunately yes, you should pay them something. 1/30th sounds reasonable.

Damn right, no flushing, showering--forget it, give them all 2/30's and grovel.

Yeah right, I'm not giving up a full 7% of the buildings income just because a SINGLE utility service was not perfect for a day and a half. and I own too many properties to be on site micromanaging all the small-time contractor work; that's why you hire them.

What monetary damages did the tenants suffer during those days?

If they had to go and purchase water for any reason (drinking water is a necessity) or if they spent money on any transportation to a facility to use their water (laundry-mat), then you owe them only for those costs. If they don't have receipts, I would comply with a request for a reasonable amount of money to cover those expenses.

However, if they were able to get by for a day or two, as many people do by using what is on hand or borrowing from a neighbor after a bad storm, then you don't owe them anything.

I'm assuming they didn't stay somewhere else during that brief time, so they must pay for the use of the rental.

If the outage had been the fault of the utility company, the utility company wouldn't pay the tenant unless, as I stated above, they tenant suffered monetary damages.

Not being able to shower or flush a toilet for a day or two might be unpleasant and annoying, but courts do NOT reimburse tenants for such things.

Your tenants are just trying to get out of paying you the entire rent.

There was a problem, and you took care of it within a reasonable amount of time. There is no way in hell a judge is going to consider anything but MONETARY DAMAGES.

You said "the plumber disconnected the well pump to do work and never reconnected it". So you are only talking about a few tenants ,it being a well could not supply a lot of tenants. Is this just a house or a couple of trailers you are the landlord of? Why did the plumber not reconnect it and what kind of work was being done? Have you paid the plumber without checking the work? How do you know if it was fixed correctly? Pay up! Loosing a tenant for a month will cost more than your saving 7%!

If you are the type of LL who has a late fee and is a stickler about it then why shouldn't the tenants get a credit for you not living up to your side of the bargain?

OTOH if you give people a break unlike most here then I would point this out to the tenants and tell them they should now give you a break.
