Want to keep my dog and not move - Landlord Forum thread 325086

Want to keep my dog and not move by Mary Lou (Texas) on September 30, 2014 @17:59

My landlord at my apartment wants me to give up my dog or vacate the apt even though my contract says we can have a dog and my doctor provided a form because I have anxieties and depression so he thought a pet would be best for me. What should I do?

Sorry to hear of your difficulties with your landlord.
The following information should guide you in dealing with the landlord.

Your doctors note has nothing to do with this so put it away, you can also drop the medical conditions because they don't mean anything.

If your lease says you can have a dog then as long as you are within the limitations of the lease (if any, such as weight breed restrictions etc.) then you have nothing to worry about and your LL can do nothing to you. If you are not allowed to have a pet, or you have a dog that does not meet the restrictions set forth in the lease then your LL may have the right to ask you to get rid of the dog or for you to leave if you refuse to comply with the lease you signed.

For the sake of argument I will assume that everything is fine just your LL decided out of the blue to not allow you to have a dog anymore.

If he continues to harass you seek competent legal advice before it gets out of hand.

What can you do? Stop being a nut case and stop causing problems for your landlord.

this is another post with too much missing info. I'd imagine the lease doesn't say you can "have" a dog ... I'd guess it says in some manner that the landlord MAY approve a dog. HUGE difference.

Did you and your doctor follow whatever is required under the various disabilities laws? A "form" probably isn't good enough.

"my contract says we can have a dog."

We need more information to answer your question. What specifically does it say? Does it say how big the dog can be, how much the dog can weigh, how old it must be, and/or say what breeds of dogs are not permitted? Then tell us what kind of dog you have.

Does it say you must pay a deposit, fee, or increased rent, and have you done so?

The tenant is making a request for a reasonable accommodation which can be either written or vebal. The request is to have a companion animal under the the requirements of the FHA. The note/letter from her Health Provider is important as it states the tenant has a disability and is prescribed a companion animal.

The landlord is required to make a reasonable accomodation reguardless of a 'No Pet Policy'. Failure to do so could result in a costly experience for the landlord.
