A residential tenant does not have 60days....where did you get that info..it is not true.

In New York a residential tenant must get one full rental period in notice..not to be less than 30 days.

So if the notice isn't delivered until the 1st..it cannot be for a move out the end of that month because the notice didnt include 1 full rental period. To be effect October 31...it have to be delivered before midnight Sept 30

BUT..commercial leases may not be covered under the same residential laws

What I meant by the 60 days was that they would functionally have that long since they were not given notice before the October rent period started (they would get all of Oct and all of November, as you said)
