There is nothing illegal about it but iff you tell him now he may be tearing up your place for the next six months and giving you a lot of lip in the process. Stick with the statutory required notice and be firm with it. Send the notice by certified mail.

Do not let the tenant tell you he is going to use the deposit money for the last rent payment. If this happens, post here again for advice. There are ways to handle that.
