I have a tenant that is becoming a pain in the ass. This month we exchanged back and forth emails for 12 days regarding rent that was due on the 1st. She tends to use "stall" or "cat and mouse" or "ambiguity speak" or simply "lie" when talking about when the rent will come. I find the best to deal with her is through email because things are documented and she starts to contradict herself (but forget) along the email chain.

Anyway this month I placed much more pressure on her and threatened her with Pay or Quit. I also explained to her that her co-signer (who's her friend) is also resp. I also pointed out her "inconsistency" in communication and her "habitual" late nature. I pointed out her "lies" through the email based on previous emails. No cursing or name calling occurred.

My question is can a tenant use this against me to say I made her fearful or feel traumatized?

Stop the emails...just issue a PAY or Quit if the rent is not paid on time. This is a business you should be in charge of , not the tenant! You seem to be in a constant dialogue with the tenant and where is this getting you?

Why would you play this woman's game? Let her fall late, and go hang the pay or quit. A pay or quit is not a threat-it is to be used as an official notice that a court recognizes when you go and file the eviction.
The key is not to make a tenant feel threatened or feel traumatized. The key is to have the rent paid on or before the date it is due. As well as the renter following the other covenants of the lease....don't waste your time with this kind of behavior.
Your other option is to just give her 30 days notice, if you have a month to month agreement.

I agree with both anons. In 12 days, you have accomplished nothing, and she has just dragged you down to her IQ level. STOP ALL texting, talking, and e-mailing. SEND a WRITTEN pay or quit notice by reg and cert mail, and also post it on the front door. Include the names of all the people who signed the lease. If no rent comes to you, or she doesn't move out, start your states eviction procedures against her.

I will back up all the previous replies. Don't engage in a dialog with this tenant. Follow your lease to the letter. Post the Pay or Quit and follow through. Either she will get the hint and pay on time or you can get rid of this PITA tenant. Don't reply to her emails any longer and send all needed communication via certified/return receipt mail.

yes, if you dare to issue her the Pay or Quit notice, than your notice will make her fearful or feel traumatized, and you will be hold responsible for all thing next!!!!

KICK THE B**** OUT!!!

In Florida, it's 3 days, then you can issue the notice.
