Uh, no. This is what insurance is for. IF this is a real post (which is unlikely) and someone were to murder your tenant in the rental home, your insurance would cover the cleanup, not the tenant's deposit.

No, it does not come out of the deposit. The Tenant is not responsible for his own murder. Good grief. That would be akin to saying that a tenant is responsible for damages caused by a tornado.

Courts would never assign this type of damage to the tenant (or, technically, his estate).

    How's it any different than charging the tenant for repairs from a break-in? Also ostensibly not his fault, but I see landlords on this board saying they charge the tenant because he is in possession.

      They can't do that either. I'd be interested in seeing a Court case where a landlord was successful at that.
