If you have a lease that does not expressly prohibit pets the landlord can not extort more money from you for having a pet. For the length of your lease, the terms can not be changed.

However, it is quite common for landlords to pick the pockets of the tenants for "nonrefundable pet deposits," pet rent and the like. Any pet damages are always taken from the tenant deposit and the money extorted by pet fees of different kinds is always pocketed.

When you pin the landlords down on the issue they will all admit they collect the pet money simply because they can. This is what your current landlord is doing.

No Bill, there is no extortion involved. Extortion is "the practice of obtaining something, especially money, through force or threats". Also extortion is "a criminal offense of obtaining money, property, or services from a person, entity, or institution, through coercion. Extortion is commonly practiced by organized crime groups." You are using this term incorrectly. The tenant is free to get the dog under the landlords terms or not. I charge a non-refundable pet fee, not because I can but because of the additional RISK I take from accepting pets and because of the additional occupant/entity LOAD it places on my property. It's just smart business to do so. I have been screwed so badly before, to the tune of a thousand dollars, by tenants pets, that I have learned my lesson. Why not just wait the eight months and move somewhere else where they don't charge for pets? Good luck finding one.

    Thanks for the scholarly way in which you describe how you pick pockets. I shudder to speculate what other "smart business practices" you teach your children.

      No, I guess you are not a business person by the language that you use incorrectly. You seem to forget this is a LANDLORD forum, not a tenant forum. How are you qualified to criticize our business practices? You seem to forget that being a landlord is a business that sometimes makes a profit. Do you teach others that it is bad to attempt to make a profit? Are you against capitalism in general? Is it ok for General Motors dealers and Chase mortgage companies to charge a fee to process a purchase or loan? What about debit card fees? Are these extortion too? The customer has a choice to do business with them or not, the same as with me. No "extortion" is used or impled.

    Bill, in addition, you are using the term " pickpocket" incorrectly as well. To wit: "Pickpocketing is a form of larceny that involves the stealing of money or other valuables from the person of a victim without their noticing the theft at the time. It requires considerable dexterity and a knack for misdirection."

    My pet fee is listed in all my advertisements, on my website, in my lease, and on the LPA form I use to account for their payment. Tenants, with full knowledge of the non- refundable pet fee, voluntarily write me a check which I give them a receipt for, record the breed and date, and add it to their lease. You are incorrectly saying that I steal their money or valuables without their knowledge. I have no skill for dexterity and misdirection. I do not steal anything.
