You are entitled to "quiet enjoyment" of your rental. The police reports will be evidence that you do not have that. The fact that the apartment is illegal complicates an eviction which is sure to go badly for the landlord as well.

Start sending the landlord receipted, certified letters expressing your lack of quiet enjoyment and advising of your impending move if the matter is not resolved quickly. This is grounds for breaking a lease without penalty. However, the landlord would be penalized because the illegal apartment would come up again.

What happens in many cases is that the good tenants move out and the worst ones are what he is left with. It is time to have a frank discussion with your landlord advising you that the trouble maker has to go or you are going. You simply can not live like this.

If you end up in court, present the police reports and make the status of the illegal apartment known.

The police were there last night. Things got pretty intense and about 20 officers showed up. What is really scary is one of the officers knew her from prior issues at ANOTHER place. To make a long story short. The woman is crazy and violent and has a long history of illegal issues as well as her oldest son. The man who originally rented the apartment did so with a fake alias and currently has an open warrant. They advised us (the tenants) to secure our homes as much as possible and to avoid them. They also told us it could be up to 9 months before she is evicted, since she will likely keep asking for extensions. Unfortunately, the police said last night they cannot make a report because it "is a civil issue"

We have decided to give it to the end of the year. If they are there as of January 1st, we are moving. Thank you for all of your advice.
