Your landlord did not evict you. He ordered you to Pay or Quit the lease. Did you return the keys? If not, you are still in possession and the landlord is evicting you. It is too late not to stop the eviction unless you want to return the key, pay the rent, pay the eviction filing fees along with the lawyer and make sure your deposit covers the mess you left behind.

Can you do all that? If not you will be evicted and it will permanently stain your civil and credit record. Good luck finding a place to rent after that.

the keys were left in the house. My posessions have all been removed. the rent was always paid. the problem was i paid him on the 10th of the month -WHEN I WAS PAID- and he wanted it on the 5th, thus charging me $5 per day , which i did not pay. i asked him to allow me to pay on the 10th and he would not do it.

    I did not leave a mess. Plus i had just installed a new hot water tank, which i left, because he refused to do so when i was still living there and i also paid $500.00 to have the furnace repaired which he also refused to pay for. I maintained the 1 1/2 acre yard, shoveled the 1/8 mile driveway all winter, paid a lot of money to have fallen trees removed from the property that had fallen down and were a hazard- he refused to do any of that so i did it. i kept the place damage free. I did not have this $5 fee per day he wanted and so i moved.

      It is hard to believe you did not have the $25 for the late fee. You could have complained to the Health Department about the heat and hot water but the landlord is not expected to mow your grass and shovel your snow.

      It is also hard to believe you shoveled the snow from a drive of 660 feet. That is a length greater than two football fields. You also could have left the trees in the yard.

      Not paying the $25 is going to be costly.

      You can sue the landlord for the cost of the water heater and tree removal and furnace repair. That is the landlords responsibility to repair.

    Unfortunately, when you sign an agreement you have to stick to it -- so if you agreed to pay on the 5th on your rental agreement, you cannot just demand now to pay on the 10th because it's more convenient for you. Instead, you have to go the extra mile to save enough from your paycheck before the 10th to pay the rent on time. If you refused to live the bargain you made, that's too bad and now you're suffering the consequences. You would have had to communicate to the landlord where you left the keys and that you were returning possession to him IAW his notice, to avoid an action for possession by the landlord. Evidently, you did not do so.

      again, he told me to remove myself and my posessions by September 28th which i did. He told ME so why would he have to be notified. The way I see it, I am very poor, struggling, obviously. I never missed a rent payment. He never put one cent into the property. I kept it impeccably clean and took care of everything. He is known by reputation to be ruthless, which has no bearing on this other than this is how he is. He told me to get out and I did. I am not sure what happens now other than if it involves money- I have none. I moved out of the place, it has no damage, it is clean and I just want done with it. He has come to my work for his rent. While I was in a meeting. Because he happened to be in this end of town. The rent was not late- he just thought he would stop and get it, just because. He laughed in my face when he told me I could buy the place for some outrageous sum and snickered "if you can come up with it- ha-ha". Again, none of this has any bearing other than to give you an idea of what I am facing. Yes, he wanted the rent on the fifth and I have paid it on the 5th many times but not always, due to my pay schedule,this "fee" thing was something he did for reasons unknown. Like i said, I am out and i just want to be done with him. Maybe I am stupid, as "Bill" alleded to earlier but I do not live there so there is no reason to evict someone who does not live there.
