No, he posted the home with a 30 day notice to quit.
unless i vacate the property and my posessions ( which i did) on or before the date of September 28th, he would proceeed with filing a landlord/tenant complaint with the local magistrate. i moved out, took my posessions, left a key.

You did not pay the late fee. By not paying the late fee you were delinquent with the rent because you did not make a full payment.

    WELL, THEN, IF I HAVE NO RIGHTS AND IF I NEVER MISSED ONE RENT PAYMENT- AM I ENTITLED TO TAKE THE BRAND NEW HOT WATER TANK I JUST INSTALLED. THAT IS MY PROPETY- I PAID FOR IT. ALSO -I PAID OVER 500 TO HAVE THE FURNACE REPAIRED BECAUSE HE WOULD NOT- AM I ENTITLED TO THAT MONEY???

      No, you cannot take appliances or equipment which have been attached to the property (via plumbing, etc.). If you were not responsible under the rental agreement for maintaining or replacing those items, you should have followed your states landlord/tenant law to notify the owner of the issue, and resolve in IAW your state law (withhold and repair, notify and move, whatever the law allowed). No other course of action can be supported, so if you installed a waterheater, it becomes the landlord's at the time of installation.

      Do you have any rights? Yes, you have the right to pay your rent and the right to remain silent.

      About the hot water heater and the furnace...You paid for the new hot water heater and furnace repair because you were stupid. We can protect people from many things but their own stupidity is not one of them.

my question was were you in communication with the landlord to coordinate your leaving? if you just moved out, he's got no way of knowing that. you need to formalize it in writing. If you just moved and said or signed nothing, he doesn't have legal possession.

    He posted a notice to the house stating that if were not out by September 28th he would evict. So I moved. I can't make it any simpler- he told me I had to go.Why would I notify him?

      sorry, you're wrong. Lots of people don't go when they're told to. The landlord can't read your mind so he's protecting himself legally. a simple phone call and 5 minute meeting would have eliminated this ... and you're going to lose ... the magistrate will rule against you since you didn't notify the landlord you were out.
