my question was were you in communication with the landlord to coordinate your leaving? if you just moved out, he's got no way of knowing that. you need to formalize it in writing. If you just moved and said or signed nothing, he doesn't have legal possession.

He posted a notice to the house stating that if were not out by September 28th he would evict. So I moved. I can't make it any simpler- he told me I had to go.Why would I notify him?

    sorry, you're wrong. Lots of people don't go when they're told to. The landlord can't read your mind so he's protecting himself legally. a simple phone call and 5 minute meeting would have eliminated this ... and you're going to lose ... the magistrate will rule against you since you didn't notify the landlord you were out.
