Ask a lawyer this question but I would think because you are also an owner, you should be able to do the eviction even though your mom signed the lease. Let us know what you find out.

Not positive but I am fairly certain that I had evicted tenants in the past where my husband was the lease signer. I know it isn't something that I double check but I do check to see if my name is on the deed as we have some deeded in his name, some in mine and some in the corporate name.

I'm also not certain but I am with you. Start the eviction. If it's not proper procedure the clerk of the court or judge will inform you.
