My boyfriend and I moved into an apartment in June of this year. His mom had no where to go, and he let her come stay here with the intentions that she was going to help out. We have had to put padlocks on doors because she has been stealing things. She refuses to find a job and help out, and does nothing but sit around the house all day and mooches off of everything. The power bill is in her name but we pay it. She has also refused to watch her granddaughter which would be my boyfriends and I daughter, unless she is getting paid to do so. So what is the proper way to get this lazy MONSTER out of my house! somebody please help!

If she is not included in the lease then simply call the police and report her trespassing. Not being in the lease means she has no right to be in the house if you don't want her there. More than likely you are in breach of your own lease, having a squatter that is in the dwelling full time but not on the lease.

Bad idea to put the energy bill in her name, have that changed immediately and then get her out of the house. If your LL finds out he will have the right to issue a cure or quit notice and then evict you if you don't add her to the lease or get her out.

If she has paid rent even one time, the police will not make her leave. You can't evict her through the courts because you don't own the property, telling the landlord may get you in hot water with him/her and the landlord isn't going to evict her unless he evicts all of you. This is a real mess, the best you can do is to convince her to leave.

Change the locks on the outside doors and lock her out. Throw her stuff out the window. Call the police when she starts screaming. After that, put the daughter up for adoption. This is no way for her to live.

Your boyfriend needs to make a decision. Is he willing to kick his mother out, and support you and his daughter? Does your boyfriend have other family members that can help him with this problem? Any brothers or sisters he could pawn his mother off on for awhile? Maybe an uncle, or somoeone in another state?

Reality is that the landlord probably has to end the lease with the whole household to get the squatter out. You should tell your landlord what is going on now - you have made a real mess for him/her.

Another option you have is to find a new place and move - call a womans shelter to come get her and don't tell her where you go. Let the landlord know that you are leaving the squatter who is on the lease behind. Again you have made it the landlords problem - and you will cost them money to get her out too. Wouldn't blame you if they come after you for these costs.....your name is on the lease after all.

Tell sonny boy - your boyfriend to find a place for her. Is he a man or a mama's boy. I will bet that you will find that he will take her side - good thing you aren't married.

Seriously, LLs?

If you're a real LL, you know that the mom has achieved tenancy status by now. It doesn't matter is she paid all the rent once, half of it, a dime or nothing ever. She has been in the property long enough to claim she is now a tenant, and a judge will agree with her. The fact that she is not on the lease is completely without relevance here.

SHE IS A TENANT. YOU HAVE TO EVICT HER LEGALLY.

You're going to have to let your landlord in on your circus and hope he agrees to evict just mom and not the whole disrespectful lot of you.
