Is this Ohio specific? I was a police officer in MD and it didn't matter if they paid rent every month. If you're not on the lease then you have no legal protection which means you could be kicked out at any time by those who were on the lease.

This always lead the LL to finding out there was tom foolery going on, but we never cared who was paying and who wasn't.

Not criticizing your answer just generally curious if you had a similar situation in one of your rentals.

I had a similar situation....
Grandmother who was my tenant allowed adult granddaughter to "stay".
They had a disagreement, the law was called. The Sheriff's Deputy told them that granddaughter lived there even if her name wasn't on the lease. And that the only person that could evict her or 'kick her out' was the LL. Which of course is how I found out about the whole thing.

    Shaun, what happened, did you serve the c/q notice? Or did the granddaughter move out volunarily?

      This happened many moons ago, back when I was just starting out.
      Learning curve in this biz, is a steep incline, if you pay attention.
      Didn't know about C&Qs, etc...

      This Grandma taught me soooo many things!!!!

      Page two of the story...
      Turns out the fuss concerned drugs. Granddaughter had already found the local dealer, punk kid. Our tenants next door filled in some of the info. Punk kid dealer was cutting through their backyard, yadda, yadda, yadda. Couldn't touch the punk kids on Grandma's property, but as soon as they stepped on another property, busted. Trust me they were just punk "wanna be's"
      Got granddaughter to leave under the fear the cops would be coming there next and didn't renew Grandma.

I don't know if this is Ohio specific, good question. From my own experience, I had a tenant who moved people in charging them rent without my knowledge or permission, in fact, not only was this not allowed per my lease but I very specifically told her not to do that when I signed a lease with her.

A day came when she called me asking me to evict her guests. Surprised, I told her, "you better get them out or I will evict all of you". She called the police who would do nothing to help her remove them which is pretty common, the cops don't generally get involved in these.

A current situation where my daughter allowed a couple to move in with her just a couple of weeks ago, had not charged them rent yet, giving them the first month free. She wanted them out of the house like this minute, she called the cops who would not make them leave but because I showed up to calm the situation down, the officer told me that it was up to me (I own the property). He wasn't keen on making them leave because the girl is pregnant but would have made them leave if I gave that call.

It appears that it is up to the officer depending of the situation to handle these on a case by case basis. Someone who paid for the space for the month can not be thrown out by an officer, if that's the case, why would we landlords have to go to eviction court to remove tenants? That's the problem with tenants renting space out of their home, if they don't own it, they can not evict anyone and they end up in a mess.
