Look up the definition of tenant in the State's landlord tenant laws.

For Ohio, Chapter 5321.01 (A) "Tenant" means a person entitled under a rental agreement to the use and occupancy of residential premises to the exclusion of others.

Is there a written rental agreement between the parties involved? If there is regardless whether she ever paid or not, this would be the only other case where the mom has tenancy rights to the home where the tenant has big problems making her leave. Otherwise, if not written rental agreement, then she is NOT a tenant. Either way, the tenants can not evict anyone period. Tenant will have to convince mom to leave.
