Tenant signed a lease stating that tenant is responsible for all maintenance except for roof, furnace, AC and water heater. Now bees have built a nest in the wall, and tenant claims landlord must pay for exterminator, or tenant will escrow the rent. Who should pay for exterminator? Will the court agree to escrow?

If you are the LL, instead of arguing who should pay, YOU need to get the bees taken care of tomorrow, and worry later about who should pay. Then, after the bees are gone,check your LL/T laws for your state. They probably will say who is responsible for pest exterminations. If a T gets badly stung, and requires medical treatment, you could be held liable for the medical bills and maybe even pain and suffering, if it turns out you were responsible for the pest control and didn't at least try to get rid of them. If it turns out the T is responsible, you can always charge the T at a later date. For you to do nothing at this point is not an option for you.

Stop being such a tightwad and hire an exterminator to get the bees out.

How many times do you want to appear in small claims for bee sting treatment at the hospital. Because I will guarantee you that absolutely every person will claim to be allergic.

This is a known hazard that you have foreknowledge of. You will lose every time in court. And big too.

I will never understand these 'tenant is responsible for all maintenance' leases. The short list:

1.) What tenant in their right mind would accept this?

2.) What landlord in their right mind would want the tenants to be in charge of maintenance (shoddy work being done, NO work being done)?

3.) What are you collecting rent for?

As a Landlord, you have a duty to address and correct known dangerous conditions on your property that makes the rental uninhabitable.

Tenants don’t cause bees and bees can do a great deal of property damage as well as possible harm to the tenant. This is the landlord’s responsibility to correct.

Find some local bee keepers. They will be happy to remove your bees humanly and do it for free as they take the queen and hives. They are BEE KEEPERS. We need bees to pollinate. Do not kill the bees as they are most valuable to the environment. If the bees in the country go, there goes our food supply! GET IT?
