Recently there was a sudden death of the landlord who has rented out two of the rooms in his house to roommates. The house is in limbo at the moment as there has not been an EX of the estate pointed through the Texas courts.

1. Does the roommates still have to pay rent and to whom should they pay? Only asking as they seem to not have this intention.

2. There was a gas leak on the property a few days before the landlord died. The gas has been shut off and it is costly to have fixed, but must be done before the gas can be turned back on. Who should cover this cost?

3. Can the roommates be asked to leave the property due to the sudden passing of the landlord as the house is in limbo and if so, would 30 days have to be given? If 30 days must be given can that be dismissed if the roommates are selling the dead landlords items without permission from the family? (the police will be getting involved)
Any advice would be very helpful, thank you in advance!!

Yes.

The Estate of <Landlord>. Just continue writing the cheque out to the name of the Landlord. You don't have to write "Estate of..."

The Estate of the Landlord. Since there is no Executor, you can repair it and send the bill to the Estate. Mind you, I'd put all this in writing first.

Although the Landlord died, the lease did not. Unless a Court wants to rule the lease unenforceable. Someone else will have to chime in on that one.

The tenants selling personal possessions of the deceased are guilty of theft. I'll be watching for them on the show "Jail".

I love seeing these kind of post. Seems like they thought they struck gold or something since the landlord dies. By default usually there are succession clauses in most leases. Therefore you still need to "prove" you are making payments to someone regardless what happens to the landlord.

-If the landlord dies you still make payments.

-If a war breaks out and there is civil unrest you still make payments

-If we experience Judgement day and God walks on the earth again, you still make payments.

-If a meteor the size of Russia is heading towards earth and will split the earth down the center killing everyone on the surface, you still make payments. If you somehow survive on the good half you still make payments.

Consider that the landlord died as your notice. It is going to be a cold winter without any gas. You still have to pay rent. What all of you need to do right now is to start looking for a new place and be out by the end of the year.

If you do not want to get wrapped up in an eviction and arrest for theft, you need to get out as soon as possible. Going forward nothing good his going to happen.
