do i have to pay rent and to who - Landlord Forum thread 328690

do i have to pay rent and to who by Anonymous on December 13, 2014 @20:51

The property I'm renting is owned by multiple family members. I have been paying rent to the person i signed the lease with years ago. Now the family is fighting and two other owners of the rental property are trying to collect rent from me or i will be evicted. Do i have to pay rent if i don't know who to pay rent to?

Oh dear. Three owners and you only signed with one of them, right?

What a mess.

To answer your specific question: You pay the rent to whoever the lease says you pay the rent to. If it doesn't specify, then you pay the rent to the person you signed the lease with.

But you have bigger problems not of your own making.

Yes you have to pay the rent. I would think that the courts wouldn't evict you because of the established pattern of the lease over the years. They would likely find that you have lived up to your part of the lease and the dispute is solely a family matter.

BUT....If you don't want to risk having the the fact that eviction proceedings were filed against you on your court records, you might want to consider making your rent check out to all three. This would mean that they all need to sign the check to cash it and then they would have to figure out how to distribute the funds between themselves. This leaves you out their dispute while still paying the rent.

Unless you've been served with something from a court, I would continue to pay who, how and where stated in your lease.

I would send a certified letter to all three stating if they wish, AND ALL THREE AGREE TO IT IN WRITING, you will place the rent in escrow with the court until their dispute is resolved.

I would look for a way to move immediately.
