she did not give 30 days notice, she wanted to renew contract and she default not paying, the contract say you have to give 30 days notice! I'm not sure I think somebody here can explain this, but I think because she did not give 30 days notice she could be charged with January?

You got the deposit and the last month. That is all you are going to get. Let it go.

You gave her notice to pay rent or move out, and she has decided to move out. She does not have to give you 30 day notice because you gave the pay or quit notice. You have last months rent, do the security deposit statement on time and re-rent the place.
