Selling one of my rental properties by John (NY) on December 18, 2014 @16:22

                              
I have a real estate agent. The property is a duplex with two tenants: one m-t-m, the other has a lease until end of march 15.
The one on lease make a lot of difficulties, refused to let the agent take pictures, and she wants visits only at her convenience. Agent canceled two prospective buyers. What can I do ( state of NY)

You need to talk to the tenant and work out a deal to get their cooperation.

One idea is to offer an incentive to cooperate, such as a $100. visa gift card or the promise that you'll aim for an investor that will keep them as tenants.

Also mention that you report to credit and tenant rating bureaus.

The tenant is interfering with the sale of the house because she does not want to move or maybe she is just a nut case. If it is possible, try to sell the house after March 15 when the tenant is out and you have had time to clean and make repairs to whatever damage the tenant leaves behind.

Whatever the case, send the tenant a notice now, by certified mail, that he will not be renewed.

Why do you think your tenant should put up with constant intrusions from your real estate agent, Work out an offer with the tenant for some type of compensation to show the rental.

If your tenant has something to gain from the sale, he may be more inclined to help the sale rather than hinder it. It’s a lot to ask of a tenant to keep the place show ready without some form of compensation. Maybe offer the tenant a rent discount or some money towards moving.

Remember, keeping the place show ready and having strangers entering the place as various hours and days is a lot of trouble for the tenant. So, do you want your tenant working for or against you?

If it says they do in the lease and they signed the lease then that is why. If it doesn't say so in the lease then that is a reasonable question.
