have a young couple who applied. he has rental history but that landlord is dead, and she turns 18 in feb. today is jan. they both filled out the app. and signed the permission paper for the background check. i know i cant run hers but he calls non stop wanting to know when they can move in. this is new to me so finding a background checking website is iffy and can she move in. do i have to allow him if his background is good. it worrries me due to it being their first place together. so on and so on. please help this is my last resort for answers.

She's 17, so you can't make a contract with her.

Since they are a "couple," I have no idea what the laws are with respect to what they are doing.

The one has "rental history," but the landlord is dead, so basically he has no rental history.

They're young, they have no rental history, and you yourself are inexperienced ("this is new to me").

This is unlikely to end well.

Pass on this couple.

I have found over the years that when applicants are in a hurry to move in, and keep pressing me for an answer, there's usually something they're trying to hide, and they want to get approved and move in before we discover it. Or, they're lying about having a good rental history and are in a hurry because they're being evicted.

Either way, do as Lighthope said, and pass on this couple. If he's pushy now, it's likely to get worse after they move in.

If you do decide to 'take a chance', do yourself a favor and make a requirement that the 17 year old provide a document from their parent or guardian that gives their permission for the underage person to live in the unit.

Also, I would urge you to require that they have a cosigner for the lease since the underage person has no background to check.

If they do well for their first year or two, then you can consider dropping the need for a cosigner.

Note, if you do decide to 'take a chance', don't do it to be nice. Only do it if you are struggling to find a renter.

This "couple" is not going to have the income, work history, rental history or credit to qualify even at your lowest standard. You can not even contract with the minor.

Next time you get a call simply respond by saying the above...that you can not contract with the minor and that they do not have the income, credit or work or rental history.

Advise the caller that they should be looking at other places because you will not be able to rent to them. End the phone call crushing all hope that you will reconsider. They want your place so bad because no one else in their right mind will talk to them.

If you get this minor on a contract there is no telling what agencies and authorities could come down on you.

More advice. Don't take phone calls as they are such a waste of time. Make them submit all the information (and more) on the LPA pre-screening card and send it to you via email. Put the card in your ads and require prospective tenants to fill it out and respond by email. Once they have your phone number they can harass you. Do not put as phone number in your ad; only an email address. Don't speak to these people until you have their information and YOU chose whom to talk to.

I have found, over the years, that over 95% of calls and inquiries are garbage. They do not meet my standards and are therefore a waste of time.
