Didnt pay deposit - Landlord Forum thread 330303

Didnt pay deposit by Shelia C (CA) on January 26, 2015 @16:52

Can a landlord evict you over not paying a deposit for a rental you already occupy? How and what are our options when it comes to paying what she asks. She is asking for twice the amount of rent plus our rent for Feb. Is this legal?

Was a deposit talked about when you signed the lease? Did you ask about a deposit when you applied?

If you are month to month the landlord may change the terms of the lease and the rent simply by providing notice. It is all legal. If you are living under the terms of a 12 year old lease you should expect the rent and deposit to be updated.

If you can get a cheaper rent and pay a smaller deposit somewhere else then you should move.

I'm with Wilford. It sounds like you have been living cheaply for a number of years, which is why you have stayed for so long. The LL has every right to update your place and raise your rent. And you have every right to find a different place to live. Check out other places, and if you find a place to your liking at a cheaper rent than your LL going to be charging you, then move. Nothing lasts forever.

These websites should clarify what can be done,

http://www.dca.ca.gov/publications/landlordbook/living-in.shtml

http://www.dca.ca.gov/publications/legal_guides/lt-2.shtml

Also many California Cities have rent control ordinances that limit rent increases and set security deposit increases.

Yes it is legal if the LL does it the right way.
Unless you are in a rent controlled city, which limits how much a LL can Increase the amounts to. However, a LL can still do it if the LL does it the right way.

Are you missing the point? She probably wants you out....

Your security deposit, which was paid twelve years ago, probably does not even cover a months rent.

Talk to your landlord about the options. She may be willing to work with you, or she may be hoping that you find another rental.
