Our original deposit was of course agreed on when we first occupied the unit, 12 yrs ago. She now wants to do interior updates and raise our rent and charge us the two dep, second month rent and the current month rent for Feb. Is this legal??

wait... Are you saying that this landlord is trying to charge you an additional deposit? On top of what they have already collected 12 years ago?

Landlords can raise rent as long as your lease has expired (or will be expiring) or if your lease says specifically they can raise rent in a given period of time. All leases must be in compliance with city, state, and federal laws. Rent controlled areas have strict laws with regard to raising rent take a look at those as well.

A landlord generally can not charge you for improvements to the property that they initiate and benefit from (aside from raising rent as allowable by law and lease)

    Yes, she is trying to collect another last and dep from us and also have to include the current months rent. So she is asking for almost 4,000.00 Feb 1st.
