I have a section 8 tenant with 7 children who breach the lease. The lease expire already and right now is in a m to m rental agreement. The problem is not rent payment.

The attorney I hired July 2014 told me to enter into mediated agreement for judgment. At that time tenants was in a lease. The case continued to February 2015 to give an opportunity to find a new apt. February came and same attorney enter again into agreement without my consent. The tenant does not want to move she does not find apt that is what she claims.

Tenant said she is confused because my attorney advise her to ask for an extension to stay. I do not doubt it.

a motion was supposed to take place february2015 and did not happen.
court date continue in March asking for execution for possession. I noticed my attorney keeps postponing and I do not see he is working for me .He seems to be working in favor of tenant and I cannot keep paying him for unsatisfactory service.

Should I decline this attorney service and I represent myself in court instead of using him ?
Should I let him keep postponing ?
He seems he is not up to my expectation.
Please advise. What do you think?

If you feel your attorney is not representing you, FIRE HIM IMMEDIATELY !! IN WRITING !! Then if you feel you can do things yourself, do so. If not, hire another attorney. There is no way it should take 9-12 months to solve your problem.

I hope you're not paying the lawyer. I hope you have put that in writing long ago and mailed it to the lawyer.
