Tenants Breaks Lease

When a tenant states theyre breaking their lease early, do you have them provide anything in writing? My tenant is leaving at the end of March when their lease is supposed to be until the end of June.

Yes, you need it in writing. A he said/she said situation will not hold up in court. Simply write a letter to your T stating that until you get something in writing, you will expect them to pay rent every month til the lease is up at the end of June. And that you will issue your 3 day notice to P or Q on the 2nd of the month. Then explain to them about how an eviction will affect them, and maybe they will stay til the end of June.

My lease includes an early termination fee (usually 2 months rent plus $300). When they tell me they're wanting to break the lease, I remind them that their written notice should be accompanied with the ETF. This usually encourages them to stay through the end of the lease. After that, if I get their written notice without the fee, (and assuming they are collectable) I file suit for the ETF and get them personally served before they leave (because if I wait until they're fully out, I usually am not going to find them for service); I typically do this a day or two before they leave, or as they are loading the truck.

I did tell this this morning that I would have to receive in writing a formal notice that they are breaking their lease early. But well see, to date they haven't been the best at communication.
I think it will be a blessing in disguise that they are moving out.
