Let's assume the decedent is bequeathing no money. A lease is not with an estate unless it was written that way. You can let the son stay until the end of the rent. Now you should give written notice that son will have to move out or fill out an application to rent. The son has to move belongings out unless somebody else intervenes with relevant info.
