I told her I had no problem with this but I would like to begin showing the apartment in July so I will have a new tenant by September, therefore only losing one months rent. I am also tossing around the idea of selling the house instead of renting. My problem is that the tenant doesn't want me to show it because she is expecting a baby on June 15. Does she have the legal right to prevent me from showing the apartment? We really cannot afford to lose the rental income. I only charged this woman $500 for rent because she was divorced and struggling. She has since gotten married, moved in the new husband and continued to pay $500 even though the water bill doubled. Rents in our area range from 800 to 1200 per month. Since I own a fairly new duplex a fair rental price is closer to 1200. >> >>>> >> >>>>>> >> >>>>THIS SHOULD BE COVERED IN YOUR LEASE. >> >>IF THIS TENANT IS MOVING OUT BEFORE THE LEASE TERM ENDS, SHE MAY BE RESPONSIBLE FOR THE RENT UP UNTIL THE TIME THAT IT IS RE-RENTED. IF YOU MUST PLAY HARDBALL, TELL HER YOU ARE ABOUT TO START EVICTION PROCEEDINGS. THIS IS NOT MEANT AS A THREAT, JUST A PRECAUTION YOU NEED TO TAKE IF SHE AND THE UNAUTHERIZED TENANT ARE NOT OUT. IF YOUR LEASE IS STRONG SHE WILL BE RESPONSIBLE FOR YOUR ATTORNEY FEES AND MAYBE MONITARY COMPENSATION FOR LOSS OF TENANCY/SALE. YOU MIGHT ALSO REMIND HER THAT THIS SORT OF JUDGEMENT WILL BE ON HER CREDIT REPORT, THUS MAKING IT VERY DIFFICULT FOR MORTGAGE/LOAN APPROVALS...GOOD LUCK! & PLEASE KEEP US POSTED. PETER MACCI>> >> >>Ask the tenant to comply with your requests in a buisness like tone. If they havent closed yet you will have more leverage. Reporting her to credit agencies can have a long lasting fincial effect for her by either not being able to get the loan or by having to pay higher intrest. Let her know that it is her choice, she can be good or bad. I can understand her not wanting any one in the house untill she is gone, but it is only a resonable request if she is paying for the month that you will loose. I usualy try to work around schedules to keep the peace, but Im not going to let it cost ME my money! If she wants to pay for it then thats ok.>>
