When you signed the new month to month lease, what happened to the $100.00 nonrefundable pet deposit? Your $200.00 fine for pets will not hold up in court. When you signed a new lease, did you have a pet clause in the lease? You knew they had a pet beforehand, why did you not inquire about it if the pet was still there? Under Nevada Landlord/tenant law, you are restricted on what you can deduct from security deposit. Landlord may only keep as much of the security deposit as is necessary to remedy any default in rent, repair any damages above normal wear and reasonably clean the premises.
NRS 118A.242(2). Your tenant can sue and received damages from you for violating the lease and law. You have acted in bad faith with your tenant and if you pursue this action, you will end of with a costly lesson.
