Is the tenant on the 1st floor in a legal unit?
If not, you are probably asking for trouble to even have a tenant in.

If unit is legal..then proceed with eviciton.

post the 'quit or pay' and proceed from there.

As for the basement. I would get that tenant out.. nicely, politely, but very soon. You are really asking for major trouble with that. Get that tenant out before the trouble lands on your head! Then, go get a C of O for it.
