You don't say what state you are in, but many states require that a PM have a realty broker's license or have other licensing/regulating requirements. If the owner reports you to the regulating body, you may well be on the hook for a much larger monetary punishment. I think you may want to review your state's real estate commission rules and take it into consideration while you're figuring what you owe the owner. Might be the better option to make the owner whole and avoid further litigation or sanction.
