Provided you use the word FEE not DEPOSIT, and it clearly states the FEE is NON-REFUNDABLE your receipt will hold up in court.
You will never be able to know the good tenant you never met because you were holding the unit for someone who paid and signed.
I had a prospect back out on me... I think they went to legal aide and got turned away because after they threatened to sue me I invited them to go ahead and never heard another word about it.
