If the tenant has a year long lease, you cannot have them sign a new one because there are other changes AND you want to include the no smoking clause--you will have to wait until this lease runs its term OR you will have to make an addendum or change in terms of tenancy or some such notice BUT for it to be valid, BOTH you and the tenant(s) have to sign it or it's not legal.
