Landlord Newsletter - Courage

The LPA Newsletter April 17, 2012

Dear Fellow Landlord,

As a landlord and property manager, I can tell you that just when you think you’ve seen it all, something new and crazier than ever happens. That is the business we are in. No two tenants or tenancies are exactly the same. Everyone is different. Some of our tenant stories are tame and others are OUT OF THIS WORLD! Interestingly, I’ve recently been contacted by a Hollywood production company responsible for a number of high profile TV shows who is looking to create a new show based on REAL LANDLORD EVICTION STORIES! It sounds fun and exciting, so below, I am sharing Jon Unger’s message to all LPA members and visitors.

We all need encouragement. I think investors and landlords sometimes need a little extra support and positivity, so please welcome Denise Dema, Business and Life Coach as she shares with us her words of wisdom and inspiration.

In this newsletter:

  • Landlord TV Show
  • Courage by Denise Dema
  • Ask the Attorney, Real Estate Attorney, John Reno
  • Landlord Quick Tip: How to Serve Notice
  • Discount on TransUnion SmartMove Credit Reports
  • "Where's the Rent?" Excuses

Please e-mail us if you have any questions or would like to add or share any material / information. Have a great month!

Got Tenant Stories?
Landlord Eviction TV Reality Show is Interested in YOU!

Attention Landlords,

Good afternoon! My name is Jon Unger and I'm a Manager of Development at Pilgrim Studios. We're the largest nonfiction reality production company in Los Angeles and are responsible for such shows as Dirty Jobs, Top Shot, My Fair Wedding, Ghost Hunters, American Chopper, Sweetie Pies on OWN, etc. You can find out more info regarding our company at www.pilgrimstudios.com.

Are you dealing with a deadbeat tenant? Do you deal with them on a daily basis or know of an eviction force that takes care of these ungrateful, disgusting, cheap tenants for you? What crazy stories have occurred in these situations? I would love to chat with someone in regards to a show idea we've been kicking around the office. It would involve an Eviction Squad getting rid of deadbeat tenants and the process behind it. Would love to know your thoughts and pick your brains. If you think you are the right fit or have a great story to tell, please share.

Developing Courage
By Denise Dema, Business and Life Coach

"Courage is rightly considered the foremost of the virtues, for upon it, all others depend." - Winston Churchill

To achieve any goal in life, no matter how big or how small, you most develop the courage to take action. So, how do we become a courageous person? Are we born with courage or is courage something we develop? How do we develop ourselves into a courageous person?

If you want to become a courageous person then the only way to develop this quality is by acting courageously. When you act courageously something miraculous happens. You feel better, stronger, and more courageous. Your confidence and self-esteem increases and you become more competent. It becomes easier to act courageously.

Develop The Quality of Courage

We are creatures of habits. It has been said that a man first creates his habits and then his habits create him. Once you start to display the quality of courage throughout the day it becomes a part of who you are. Being courageous becomes easier to do with each courageous act you perform. A courageous act does not mean you are putting yourself in danger. A courageous act means you are doing the things that you fear.

Most of us fear something but the truth is that most of our fears are only a product of our vivid imaginations. Unfortunately, these fears often cripple who we become and what we do in life. Fear is limiting and since fear is self-imposed we can cure ourselves from fear quickly and easily. The cure for fear is courage. The cure is in the act of doing the things in which you fear. When you do the things that you are afraid of you take control of your life rather than allowing the emotion of fear to control your life.

"Do the thing you fear, and the death of fear is certain." Brian Tracy.

Courage is not a special quality reserved for a select few individuals who were born as courageous people...

Ask the Attorney

John Reno also does Mortgage Loan Modifications (Nationwide).
(Mention The LPA for a 10% discount!)

Dear Mr. Reno:
My wife and I started renting to own, to a couple three years ago. With each 12month contract they were supposed to purchase the home. They never did. They have consistently been late every month with rent and they are now renting month to month with no contract. We now really need to sell the property. What steps do we need to take to have them vacate. We live in TX if that makes a difference. Your help is greatly appreciated. Thank you. - Michael, TX

A: Legally, they need to get a notice prior to 5/1 that you want them out by 6/1/12 (or 7/1/12 if you want to be nice.) Would you consider talking to them first?

If you have a landlord tenant problem you'd like to ask a question about, please feel free to e-mail me your question.
Submit a landlord / tenant question for Mr. Reno
Please try to keep your questions as short and to the point as possible.

Landlord Tip

Giving proper legal notice to tenant:

(This applies to month to month tenancies or if your lease allows you to make unilateral changes to the tenancy as the LPA Lease does.)
* It is important to remember that proper notice must also be given by the tenant or the landlord for the Intention of Non - Renewal. Even though the lease has an expiration date, the landlord must still require a written notice to vacate from the tenant.

If it is a 30 or 60 day notice, be sure that the written notice is served before the beginning of the next rent period. That means if the rent is due and payable on the 1st of the month, have the notice served before that date. Serving a notice in the middle of a rent period will not change the fact that the 30 or 60 days notice period starts on the first day of the next rent period. An official dated notice should be delivered / "served" to the tenant, (preferably by at least 2 of the following methods)

  • in person (preferable)
  • sent by certified mail- return receipt requested
  • regular first class mail combined with the above. We recommend getting a certificate of mailing receipt from the post office whenever you mail an official notice by 1st class (regular) mail.

A Tenant Screening Alternative...

TransUnion SmartMove Discounted For LPA Members!

TransUnion Credit Bureau has partnered with The Landlord Protection Agency to provide an alternative option in on-line tenant screening. Private landlords who choose to avoid the qualifying process required for establishing a direct access account for credit reports now have another way. TransUnion gives LPA Members discounted access to LPA Members $5.00 lower per report than what TransUnion charges directly.

How does SmartMove work?
SmartMove is used when someone is interested in applying to rent a property. In order to begin the process, the potential renter MUST provide an email address to the landlord. Once the email address has been provided, the process generally goes as follows:

  • Landlord initiates a screening request using the email address provided by the applicant. (If the landlord is new to SmartMove, he or she must create an account and add at least 1 property.)
  • Rental applicant is sent the application request via email and chooses to accept or decline the screening. (If the applicant is new to SmartMove, he or she must create an account in order to accept or decline the request.) ...

Tenant Reporting

Have you ever been beaten by a tenant on the rent? Most of us have and unfortunately, it is one of the costs of doing business as a landlord.
On the brighter side, remedies are available for many. If you have documented your tenancy with the proper paperwork including a rental application, lease agreement, late notices, etc., you may have a chance of collecting.

Credit bureau reporting is an option in which many modern landlords are beginning to participate....

"Where's the Rent?" Tenant Rent Excuses

"I'm waiting to see if my offer is accepted. We're BUYING A HOUSE!!! YAY!"
That is nice that you are buying a house, but now you owe a late fee and if you do not pay the rent, you will be moving with a bad credit record. - Andrea J., NJ

"If we were married, you wouldn't charge me rent, would you?"
Uh oh! Single tenant keeps coming on to me... Besides, why would I want to marry someone who keeps stiffing me on the rent? - Harley B., NY

"Sorry... I just don't feel comfortable paying the rent at this point, unless I know there will be NO INCREASE in rent with my renewal."
Since the lease doesn't expire for 3 more months, we have yet to determine if we will even OFFER a renewal! I'm thinking NON-renewal! - Marguerite in Mission Viejo, CA
