The Top 5 Reasons Landlords are Afraid to Evict

Many landlords are so afraid to evict a tenant that it costs them far more in the long run that it would to just bite the bullet and go through with a legal eviction.

Let's face it. Evictions are not a pleasant part of the business. Collecting rent on time is. Having your rental property cared for by a tenant who pays the rent is essential to being a successful landlord. But what about when things don't go so well? When tenants don't abide by the agreements made in the lease?

I always say, "It is better to have NO tenant, than it is to have a BAD tenant." I say this because I would rather have an empty rental property than one with a deadbeat loser who:
a) doesn't have the integrity or responsibility to honor his agreement,
b) is stealing from me and my family for every day he gets away with not paying the rent,
c) is costing me time and aggravation in managing a hopeless tenancy.

Most landlords can't afford to be Good Samaritans who provide free housing. The rent needs to be paid or they will lose the property they worked so hard to acquire in the first place.

So What Are The Top 5 Reasons Landlords are Afraid to Evict?

  1. Fear of the Unknown I've noticed that landlords who have never experienced evicting a tenant in court before will do whatever it takes to avoid the eviction process, even at greater cost to themselves than an actual eviction would cost. I've also noticed that landlords who have evicted a tenant in the past are more willing to evict again when it needs to be done. Experienced landlords know that evictions should be started immediately, once the tenant can not cure his default on the agreement.

  2. No Attorney "I don't have an eviction attorney" and "an attorney is too expensive" are common excuses for not starting an eviction ...

14 Tricks and Cons Tenants Use

Most of the sneaky little tricks listed below can easily be thwarted with proper tenant screening and a little landlord tenant knowledge.

  1. The Old Fake Credit Report Trick:
    With today's computer technology, it is quite easy for a tenant to fake a credit report. Anyone can get a free copy of their own credit report online and make a few "modifications" on it before printing it out and presenting it to an innocent, unsuspecting and impressed landlord.

  2. The Old Totally Fake Identity Trick with great credit report:
    Fake IDs are sold to under aged kids who want to get into bars all over the country. It is easy enough for a con-man tenant to get a fake ID to match his friend's or relative's credit report and present him/herself as that person. It is a good idea to check IDs carefully and verify as much information in that person's name as possible.

  3. The Old "I’m a victim of Identity Theft" Trick:
    A popular excuse for a bad credit report. Blame it on identity theft!

  4. The Old "My spouse ruined my Credit" Trick:
    A popular excuse for divorced deadbeats. Blame it on the Ex!

  5. The Old Fake social security # Trick:
    Many fraudster rental applicants present fake social security numbers on their rental application. Often it is their child's or a made up number that brings incorrect or no results. When asked for an explanation, they may pretend they don't understand why this happened ...

    Rental Binder Form

    This is one of the popular Rental Binders used by many Realtors. Similar versions of this form are used by landlords and real estate agents across the US. Many people actually use it as a basic rental agreement! It's not really meant to be a rental agreement or rental application, but is a pre-contract form used as a binder receipt to show an offer has been made with an earnest money deposit. Upon written acceptance of the offer by the owner/agent of the rental, it becomes a binder, whereby it is agreed that the rental will not be rented to anyone else before the agreed lease signing date. When not using the LPA Rental Application, this form is especially helpful to rental agents who collect their real estate commission from the tenant because it provides for a written agreement of the rental commission.

    Dear Mr. Reno:
    Security Deposit Question: My tenant of 13 years faux painted the walls without permission and in violation of the Lease. When I first I saw the shiny green ceiling and peach walls and mentioned his Lease Clause, he made an oral agreement to paint upon leaving. However, I may need to start eviction proceedings, so there goes the paint job!
    The paint is long past its useful life. But, the dramatic color change and shine mean that I can not longer repaint with one coat. Painting is a landlord expense. Can I deduct anything from Security Deposit? The cost ofa prime coat perhaps?
    Also, the countertop is 30 years old but he burned a big hole in it. I assume that since it is past its useful life, I am out of luck on that as well.

    A: Both. I can see both claims can go either way, the counter and the paint. It's up to the judge. You'll need to act promptly in Ca. Get receipts or est. and itemized deductions in writing within 30 days. Deduct both, and let the chips fall as they may.
