<description>Hi&lt;br&gt;&lt;br&gt;Apologies for double-posting.  I put this comment as a reply to an earlier thread to which it is a follow up, with some updates.  The realized that adding comment to old thread does not bring it to current position in forum.&lt;br&gt;&lt;br&gt;Original thread was &lt;br&gt;http://www.thelpa.com/lpa/forum-thread/292230/How-to-get-unpaid-rent.html &lt;br&gt;but I am still a little confused what to do next as situation has changed somewhat.&lt;br&gt;&lt;br&gt;Tenants moved out of their own accord on 17th June (yesterday) - the same day that I served a 3 day pay or quit notice to them. They did not say anything to me - just left keys in my mailbox.&lt;br&gt;&lt;br&gt;Apartment is in a horrible state with dog urine and stains on carpets, generally dirty, washing machine broken by misuse, blinds and curtains damaged. They left loads of garbage (even bags of dog faeces!!). It&apos;s so upsetting _ I had the apartment so beautiful for them and freshly decorated only 10 months ago. Unbelievable that so-called professional people would behave this way (one is a lending advisor at a local bank).&lt;br&gt;&lt;br&gt;So now they owe 2 months back rent, plus damages.&lt;br&gt;&lt;br&gt;My questions are:&lt;br&gt;&lt;br&gt;1) should I still file for eviction (its pretty clear that they have left) or should I just go straight to small-claims court for damages?&lt;br&gt;&lt;br&gt;2) I have final month&apos;s rent pre-paid. Given that I issued a pay-or-quit notice can I still keep the prepaid rent for next month, July, until new tenants move in Aug which is when their lease should have ended?&lt;br&gt;&lt;br&gt;Thanks </description>

<description>After doing last years taxes it occured to me that it is no longer profitable to be a landlord in Michigan anymore . The state has so many tax laws now , that you hardly do any write offs anymore . It seems that it has become a tenant friendly state like CA. &amp; NY. People are allowed to trash your property and then turn around &amp; then sue you , while lying through their teeth in court . Does anyone else believe this to be so ? </description>

<description>I&apos;ve had a tenant that started out section 8 and then year by year HUD reduced their payment amounts down to zero and now the the tenant is off the program paying on their own.  Overall over the years the tenant was not bad and recently here I had made some improvements upon their request.  They really like the home but the lady made the mistake of moving her no good husband into the home and he immediately got hurt on his job and is now on disability not doing anything but collecting a check while she works. Short story is i bent over backwards trying to help them out with rent arrangements but they are horrible with communications.  She made this statement lately with hostility that she refuses to pay all the rent.  Before I fire back, my first intent to send her a certified letter to have her officially move out.  The husband is a deadbeat and they are big liars like most section 8 and former section 8 people are.  Is sending the official letter to let them know their time is up in August the way to go by law?  After 9 years in the same place, are chances they will have someone call me for a reference after so much time possible?   I do have her SSN on file and plan to use it if need be.  Any suggestions will be greatly appreciated.  What a shame people are deadbeats after you try to help them.</description>

<description>A female T signed a lease for 6 months - all was fine. After 3 months she&apos;s gone &amp; her boyfriend is still living there.  He tells me that they split &amp; he has a new girlfriend.&lt;br&gt;&lt;br&gt;He asked me to cross out his old girlfriend from lease &amp; make him the T (he says he will pay rent until lease is up in 3 more months).&lt;br&gt;&lt;br&gt;I tell him I can&apos;t do it because his first girlfriend never signed off as T.  Utilities are in her name &amp; she never told me that she wants to quit.&lt;br&gt;&lt;br&gt;The boyfriend insists that he does not want her on the property since his new friend has moved in.  What&apos;s going on here?  I&apos;m a little confused about this setup?&lt;br&gt;&lt;br&gt;The rent is due in a couple of days - I&apos;ll see if the original T pays (i will not accept payment from her boyfriend)  If she refuses to pay rent should I post PAY OR QUIT notice?&lt;br&gt;&lt;br&gt;                   Thank  You</description>

<description>My unit is one of 450 in a highrise. Some tenants are no so clean, so I guess roaches from there walk into my unit. I only see 1 per week. I am not a big fan of pest control chemicals. &lt;br&gt;&lt;br&gt;What I do is tell prospective tenants they might see a roach on occasion. If they feel it is a problem they can hire a pest control company and I will reimburse $100.</description>

<description>I had an applicant on one of my units. She was qualified. I accepted it and, in my terms, she had 7 days to sign the lease and give me the security deposit and first month&apos;s rent. After 7 days, she forfeits the unit and I keep the earnest deposit...all written in the info I give out with the app.&lt;br&gt;&lt;br&gt;Day 7, she asks for a week extension because she doesn&apos;t have the money. I said no and started calling everyone that was wait listed back. If she can&apos;t make the first payment on time, it doesn&apos;t bode well for the future.&lt;br&gt;&lt;br&gt;Now, a week later, she came up with the money and wants the place. Can I refuse to let her reapply? Or, can I refuse her app on round two just based on the prior situation. My application terms don&apos;t say anything about second applications or that forfeitures being permanent. &lt;br&gt;&lt;br&gt;The icing on the cake....she&apos;s a law student. I don&apos;t want any legal issues since she knows she was qualified before. She knew when she filled out the app that she would have seven days to cough up the money and, frankly, she&apos;s apartment hunting and knows darn well that any landlord will want money. I really don&apos;t want someone this flakey renting from me. &lt;br&gt;&lt;br&gt;I was hoping to just have the unit rented before she came back, but no luck there...&lt;br&gt;&lt;br&gt;any advice?</description>

<description>Dealing with the tenant who brought home the pit bull here..&lt;br&gt;&lt;br&gt;My certified letter got returned to me today, USPS marked return to sender, no receptacle?!?!&lt;br&gt;&lt;br&gt;I&apos;ve talked to USPS and they said their end says undeliverable but nothing about there being no mail box.  I have to drive out to the property tomorrow to check if there is one there, but I have NEVER had this problem before.  If it is there, what do I do?? Make USPS correct this on my unopened certified letter?&lt;br&gt;&lt;br&gt;Is the certified letter now negated?  Do I send it again?&lt;br&gt;&lt;br&gt;Obviously, if the mail box is NOT there, do I file a police report?  Or does my tenant?  Why would my tenant not tell me something like this?  Especially when she nags about every single thing under the sun??&lt;br&gt;&lt;br&gt;I have NEVER had this many problems with one tenant, but they wont leave - they love it - could have fooled me..&lt;br&gt;&lt;br&gt;Help please..!</description>

<description>I am a new landlord and has learned a lot from this forum.  I just received one application from my realtor for my SFH.  The applicant is the mother who has a good job, good income and good FICO score.  However, mother doesn&apos;t want to live along so her daughter and son-in-law and grandchild would move in with her.  Daughter has very good FICO score also.  Daughter and son-in-law have lived in the same apartment for 12 years.  I told the realtor that I need the son-i-law&apos;s credit report.  Also, all three adults need to be on the lease too, and their individual income will also needed to be qualified.  The realtor said that she doesn&apos;t think the daughter is working now because she has a baby and is expecting another one, that&apos;s why the mother wants them to live with her - it&apos;s like that the husband is working but the wife is home with baby.  My realtor thinks this is a great application.  Should I consider this applicant?  Any suggestions?       </description>

<description>I rented a house with a signed lease agreement dated May 20th. The agreed move in date was June 15, (prorated the month) The tenant viewed the home prior to renting and signing the lease agreement. The previous tenants moved out prior to their lease actually being up (5/31) The previous tenants did not do such a good job cleaning the place-mainly dusty. We gave them the opportunity to come back and clean the place otherwise we would deduct from deposit. They ended up contacting us saying to just deduct the cleaning fee. This past Thursday I met with the new tenant to do a walk through. She was not happy with the way the house was cleaned, even though she took the keys, paid the rent for remainder of June. I told her I would have redone the areas she was concerned about and they could move in on the 15th. Come the 15th, the house still wasn&apos;t clean enough for her. She was griping about the baseboards, the grout in the kitchen/dining area and some dust on blinds. She also wanted the strip along the tub replaced and linoleum in the bath retacked down and a new corner strip added. Minor things that I had no problem fixing and agreed to do and would touch base with her today. I even agreed to refund the past 3 days, because she refused to move in until these things were completed. So today she tells me that they are not moving in and want their rent and deposit refunded. She came and got the belongings that she had already put in and returned the keys. There is a clause on possession and says that the agreement shall not be void or voidable if owner is unable to deliver possession. We were able to, she just made some minor cleaning issues a big deal. What are my rights? she is barking that her father is an attorney blah, blah. (not in GA of course) Now I have to put the house back on the market, etc. Advice please... WWYD?</description>

<description>Tenants were served and we immediately filed for default after their 5-day response time was up. The court said it will be entered within 4 or 5 days. All we can do now is wait, but during the next few days, can the tenant still respond until the default is actually entered by the court? If the tenants had responded would entering their response also be delayed by the court? I didn&apos;t realize there would be a waiting time by the court so I&apos;m worried I might be in for a surprise. Basically want to know if they respond today would their papers be in the same &quot;line&quot; as ours?...meaning that since/if we submitted first ours would be processed first.</description>

<description>So I finally got an court eviction and judgement for 4 months back rent, the tenants have 10 days until the Sheriff will evict them.  &lt;br&gt;&lt;br&gt;Is there anything I need to do to protect myself, other than demanding the key? <description>I own a duplex and installed a satellite dish on a pole, stabilized with cement for one tenant, on the other tenants property. There was no other place to get a signal besides the small breezeway that belongs to another tenant.  Is this legal in Oregon? I cannot find anything online that tells me if I had to ask permission to do this.</description>

<description>Once in a great while (2 times in 18 months) there is some water that appears in the basement. It is a small amount that creates about a 8 foot circle in the middle of the basement and has a line that goes to the one of the walls.&lt;br&gt;We have had lots and lots of heavy rain the last couple of days. &lt;br&gt;The house was built in the early 70&apos;s so it is not a new house but in very good condition.&lt;br&gt;The tenant is demanding that I fix the issue as his boxes of junk in the basement have gotten wet.&lt;br&gt;I just purchased the property 18 months ago and the condition report stated that they had some water come in the basement once while they owned the property however could never figure out where it came from. &lt;br&gt;&lt;br&gt;Is this something I need to worry about with the tenant trying to come after me for not fixing it.  </description>

<description>Had good paying tenant for about a year, then her handicapped son came to live with them so they needed a bigger place.  Moved them to three bedroom house. She discovered 1st week that there was a mouse in the house and the toilet was leaking we took care of it.  Then She complained about a spider in her bedroom.  Then we have a bad rainstorm one day and she calls and tells me her bedroom has flooded. We had trouble with water coming into this room about 5 years ago, but we put in new gutters and an underground drainage system and that took care of the problem.  Last Tenant we had there for 3 years no water.  My husband and son headed right over when she called and extracted the water, left fans and dehumidifier.  Next day I get a text she wants her security back and she is leaving at end of June, she just moved in June 1st and has year lease. Today I get text that she is getting a judgement against me and that we have a court date set for JULY 25th 9am.  I have not been served with anything yet.  Cant believe shes doing this!  Had almost 5 days of rain at beginning of June and no water in bedroom then one after noon many days later and she is flooded, though water also came on the side of the Laundry Room not just on outside wall. So that got me  wondering if one of the kids opened the valve to the water lines, (they dont have a washer or dryer in there yet)and the flooding really came from there and not the rainstorm.  Does she have any grounds to stand on? She wants me to pay t for the mattress she had on floor, a book shelf she says is damaged, clothing and toys.  &lt;br&gt;She also wants her security Deposit given to her before she moves out so she has money to put down on some place else.  I moved her security over from her 2 bedroom apt.  Any suggestions? or does she have right to expect me to let her leave and pay for supposedly damaged stuff? I am thinking its her problem, she should have purchased Renters insurance, Right?  Thanks for your responses.</description>

<description>Got an applicant in his mid 60s--he has retirement income from SS. He has no car, &amp; his income is a little under 3x the rent we ask, he has rented for the past 4 years at two different places (the latest place is being sold, so he&apos;s looking for a new place).  &lt;br&gt;&lt;br&gt;He disclosed that before he became a renter, he had a house for 25 years and then it went into foreclosure &amp; then a short sale.  I&apos;m thinking most mortgages are 30 year fixed, unless he did an adjustable, but gee, if you live in a house for 25 years, would you let it go into foreclosure?  Granted, I don&apos;t know the backstory--maybe a divorce, maybe overspending, whatever.  &lt;br&gt;&lt;br&gt;Any thoughts?  TIA&lt;br&gt;&lt;br&gt;</description>

<description>I don&apos;t really need advice (although I&apos;ll always take suggestions) I just want to gripe about Society as I see it here.&lt;br&gt;&lt;br&gt;We have 25 units (some SFH, some apts)and have been landlord-ing since 2001.  We were doing pretty good until about 4 years ago.. It is taking me longer and longer to rent these properties..it seems the quality of applicants is going down and down.  All I&apos;m asking is for someone to 1)pay the rent 2)make it their HOME (ie,don&apos;t trash the place)&lt;br&gt;&lt;br&gt;I&apos;m seeing LOTS of young girls with babies and income that is usually TANF &amp; SSI (or disability for the child). Sometimes the girls have boyfriends, but the girls usually claim to not be attached...The latest was a 19 year old with 3 kids!!...Yikes!!&lt;br&gt;&lt;br&gt;I used to put my requirements in my ads (either print or internet)..No one called.  So now I wait until I get a call and then talk to them some, then gently tell them the requirements (no pets, income 3X rent, bkgrnd check where drugs,violence,evictions need not apply).  They usually say I&apos;ll think about it and call you back, Right!!... I know its better to have NO tenant than a trouble maker, but with a 30% vacancy rate, we are thinking about selling some of these. Just feeling worn down by the entitlement society I guess.&lt;br&gt;</description>

<description>I have tenants who were repeat offenders of being late on rent.  They lead me to believe we had a real relationship and asked for understanding because they had two kids.  At one point after trying to collect rent I asked her if I am gonna get screwed here.  The tenant responded to me that her mother works at a law firm and gets free legal services.  She told me not to worry, she would not go down the road that we would have to evict them and get a big expensive lawyer.  Though I took her word, it sounded a bit like a threat to me.  Surprise, surprise, here we are.  I had to file landlord tenant complaint and even though they told me they would be out in 20 days, I filed for eviction.  Thank goodness, because they were not moving. But they also never paid what the court ordered they pay. &lt;br&gt;&lt;br&gt;Now, I find more and more damages, things they left, they left trash, trashed things, stuck me with their utilities for the last quarter which they lived there, made alterations to the house I did not approve.  One alteration I think is the cause of much further damage.  And because they are broke, they have nothing.&lt;br&gt;&lt;br&gt;But I am in fear they come after me.  I called the court house asking if I could get rid of their &quot;trash&quot; in my house and I was told the court house cannot answer that.  Even though the paperwork from the court says 30 days for an appeal (passed and no appeal filed) and 10 days for the tenant to notify me if I need to hold any of their property (again past 10 days).  I was instructed to call an attorney.&lt;br&gt;&lt;br&gt;The costs in this are up to almost 15K and they have not a dime to make it worthwhile to go to civil court.  I am terrified and scared they will come after me and accuse me that I threw out something of value to them, though I see nothing of value and I am in the time frame.  The lawyer I called advised me that I cannot protect myself from them coming back, just document really well everything.  How can I afford this all - are their support agencies to help fight such people?  &lt;br&gt;&lt;br&gt;Is there a time limit when I can finally sigh and know this is all over?&lt;br&gt;&lt;br&gt;From what I find out, it seems they are career offenders in this area of moving somewhere then not paying.</description>

<description>I am a landlord of a two-family home in Brooklyn. I man invilved ina hold-over eviction case with my tenants. They tenants have made repeated false complaints against me in an attempt to have their rent cancelled: no heat, illegal lock-out which called in police, illegal basement apartment, and most recently infestation of flies. NONE of these complaints are founded but they have already received 2 adjournments while these false calimes were investigated. I have to live in the same house as them and I don&apos;t know what to expect next. What can i do?  </description>

<description>My lease states that my tenant is only allowed to one dog. &lt;br&gt;&quot;Tenant shall be entitled to keep no more than one domestic dogs, cats, or birds; however, at such time as Tenant shall actually keep any such animal on the Premises, Tenant shall pay to Landlord a pet deposit of ZERO dollars of which shall be non-refundable and shall be used upon the termination or expiration of this Agreement for the purposes of cleaning the carpets of the building. &quot;&lt;br&gt;&lt;br&gt;My tenant is keeping a dog, which is allowed, but they are also keeping squirrels. My understanding is that it is illegal to keep squirrels as pets in my city. &lt;br&gt;&lt;br&gt;I wanted to know if I am good to evict or if I need to give her the option to cure this lease violation. I am in NJ&lt;br&gt;&lt;br&gt;</description>

<description>The rental market here in Denver is pretty intense right now.  We have had over 90 people respond to our ad in only 2 days.  We are opting to have an open house rather than try to set up numerous showings.  My question is how do we handle this level of interest?  Even if only half come to the open house that is still close to 50 people.  I don&apos;t feel comfortable accepting money from tons of people if they all want to submit an application.  Are there any graceful tactics for limiting the number of applications we hand out?  Usually we only have about 20 people interested, and maybe 2 of them actually fill out the app, so we have never been in this situation.</description>

<description>We just moved out of our rented home and the landlord emailed us saying he would like to return our security deposit and was asking for our new address and said it was per the lease agreement.&lt;br&gt;&lt;br&gt;Looking at the lease agreement, we do not see anywhere where it mentions that we need to provide our new home address. So we asked me to use the old home address (the place where we rented) as it&apos;ll get forwarded to us. He replied saying that as per rules of the lease agreement we had to send him the home address. We looked at the California tenant-landlord rights and it does not say anywhere. When we pointed this out to him, he said the address is required for &quot;many legal reasons.&quot; We again emailed him politely asking what those reasons were, the landlord sent us back a rude email saying we were not playing by the rules as his other tenants do and he can get our address as it will be public anyways. He completely dodged the question we asked.&lt;br&gt;&lt;br&gt;My question is, are we required to give our new home address? After all this, we do not feel like sharing this information. What are the rules of the legal agreement he is talking about? What are the legal issues he is referring to?&lt;br&gt;&lt;br&gt;Thanks</description>

<description>I have a couple living together. She has 2 boys 16 &amp; 8. She checks out but he does not but he works and has a decent job and she needs his money to live comfortable. His criminal history does not look good in the past. We were thinking of renting to her and having him as a occupant. How hard is it to get an occupant out if he breaks the house rules? Would this be a good idea?? </description>

<description>I am in the process of selling my rental home (it is not listed as yet) in-the-meantime, the rental lease with tenant has expired.  Would it be wise to tell tenant up front that the house will be going up for sale or should I have them sign the lease before making such announcement?</description>
