Lease Violation - Landlord Forum thread 120877

Location: Alabama
We just signed the lease for a new tenant as of 4/24/06. There was a MAJOR discussion about the 6 week old pitt bull puppy he wanted to bring to the house. We stood firm and told him we have a NO PET policy. Our rentals are landscaped and we don't want the hassle of damages pets can cause. We told him if he wanted to rent from us, the dog could not come. Today we went by to drop off a new fire extinquisher and guess what! Not only was he living there with NO utilites, he had the puppy there. My husband wants him out. He hasn't even been there a week and decides to violate his lease. What ground do we have to make him leave?! Or do we have to give him the opportunity to correct the violation?

Give him a Lease Violation Notice sent by certified mail and also a copy sent by regular mail.

I can't possibly consider a tenant responsible if they make the choice of getting a puppy right before renting - or worse: AFTER the landlord said NO PETS!
(Unless of course it is for medical theraputic reasons - Hah!
What a moron. Don't these people know that most landlords don't want pets? Don't they realize their chances of getting a nice rental are greatly diminished?

Put 10 days notice to cure on your Lease Violation Notice.

Get educated. Read your state laws on this site. But your husband is right. I would run to the closest lawyer, and proceed forward. Follow the lawyer's advice. Blatent disregard of the lease-possession of a pet, and no utilities. Did he have trouble getting the utilities turned on? There is no excuse for the puppy....this tenant is going to cost you more than the security deposit will ever cover.

If this is what you're face with at the get-go, just think of the problems you'll have throughout the Lease term. I'd do all in my power to get rid of this tenant IMMEDIATELY. Besides, with what's going on that insurance companies are denying coverage to people with certain types of breeds (dogs) it can get real messy I'd guess.

Personally, if somebody says they want to bring a puppy, then my propery would not be for them.

I don't like renting to folks who clearly state that they would like something that I don't allow.

That means at the least, they'll be unhappy, resentful tenants, at worst, they'll go ahead and fulfull their desires anyway against the rules.
