No, you don't sign a lease with only a deposit! You fill out the application with a deposit. Did you fill out an application? You signed that and that is all the proof that landlord needs. I don't know what application you signed, but mine covers my loss if you change your mind. And there's a good chance that the application you signed has a clause in there forfieting your deposit as well. Go ahead take your chances and file in court, you don't have a copy of your application.

    Did you get a receipt for the deposit? Why would you give a stranger money without filling out an application? Not good business to promise the apartment to you without an application. How do we know that you didn't drag your feet and extend the time for signing the lease and taking possession or filling out an application for that matter? There are so many factors here, we can't make an honest decision without hearing both sides. As a rule of thumb, if tenant changes their mind, they lose the deposit. Without a receipt and without a signed application, it will be a "he said, she said" You can take your chances and file with the court and see how it comes out.
