we agree, the situation stinks, bad, and they can rent this place out per nite for $200+ and we are paying $1,200/month so they want us out!

basically the owners daughter rented the place to us out from under her vacation rental agent and created a huge mess for everyone and is now denying everything she told us of course..

also, we cant move that soon, that's why it's a problem for us!

Like I sai before... This is a vacation rental. The normal rules do not apply. By your own admission, you have paid for June, you are required to be out at the end of that term. Just because you want it to be a permanent place does not negate the fact that it is a vacation rental. I'm sorry, but I doubt any court would entertain this.

It sounds like the daughter did a side deal without permission. Since she is not the owner she did not have the right to give you posession. At least that s how they will put it. Did they run credit checks, criminal background, rental histories? If not, that would just support their case that this is a vaction rental.

At least you don't have a lease so you don't have to pay them rent next month. All you have to do s pack up and get out. I take it that the place is furnished (it being a vacation rental and all) so it shouldn't be that hard with no furniture. Take the money that you were going to use for rent and get a hotel room until you can find a permanent place. In the future, only go with a reputable LL that does full background, criminal, and credit checks. Those are the ones who are more likely to take it seriously.

If the property is not long term rental, not only do the renters' right change, so do the tax and local laws. Vacation rentals are a different ball game, you'll need to research them because you are not a tenant, and the owner may be on dodgy legal ground if they try and mistakenly treat it like a regular rent. Chances are, it's not licensed for it, just vacation rental.

Just because you and the person you met didn't understand this, it doesn't change the laws of the land. You knew you were getting into a vacation rental, therefore you are just as much to blame as the owner's daughter incompetence. It's sucks for all concerned. You need to find somewhere else to live. If you're a renter by life, you won't want a court case on your record. A prospective LL will pull up your details, see you were involved in a property court case, and reject you out of hand.

You and the parties need to sit down and stop acting like possibly uninformeds, it's not a personal battle. Mistakes were made and you need to move forward. You HAVE to leave, you are not M2M, regardless of what people thought. When whatever you paid runs out, you are illegally occupying property. Quite a shock huh?
