Re: bounced rent check - Landlord Forum thread 187917

Re: bounced rent check by winky (nc) on September 25, 2009 @15:51

sorry, i should have been more specific. the lease is m2m, signed on 8-15. The rent was due on 9-15, and has since bounced. It is in the lease if I don't have it on the 15th, there is a $30 charge, but there is nothing about the returned check fee. So I can still charge for that right? Would it be the amount the bank charged me?

If you are talking about a bank charge then go ahead and ask whatever they ask. Just make sure the tenant understands a check is not adequate for payment.

If your lease provides for it, you may collect both the late fee and a bank fee. Just be sure to factor in the cost of being right.

There is nothing about returned check fee, so you cannot charge for that this time. Charge for late fee and send 30 day notice of change to lease terms to include returned check fee or that you no longer accept personal checks.
