I would say one point of damage is due to the leaks underneath the house my very first water bill was 758.00. Woke up one morning to my daughter trying to wipe the water from her tv that got burnt out because it rained while we were sleeping and water ran all down her tv(that's how I first found out we still had leaks in the roof) and there is more. Now as I said certain things were visable but also fixable, then I find out certain things have been reported but patched up so no one could notice it. A lot of things were misrepresented with this house and I believe they already knew. They told me when I signed my lease the house was electric and water but it was not, that was found out 2 days later when she sent an electrician out to see y the hot water wasn't working that it ran off gas, I was told central a/c but when she sent hvac 2 see why no cold air they said no a/c unit and showed me where it would sit if 1 was there, and the central heat and it runs off gas and showed me where the gas line ran. So this house was also misrepresented.

You could void the contract if there was fraud in the representation of the house -- but with her sending repairment out to repair things that aren't there, it sounds like she was not misrepresenting, but simply didn't know the property very well. And any reasonable person would point out that you should have seen an central HA/C unit if there was one (although it could have been in the attic -- but in June, you would have heard something running, heat or a/c).

I really dislike it when a tenant has every opportunity to check out the property and locale, but after moving in decides they don't like what they signed on for.

Since you say you're new to leasing, I'll add a few unasked-for comments. Don't move into a sub-par home -- most slumlords aren't fixing things and most properities are viewed in their as-is condition; most courts would say, you saw the problems and rented anyway, so you accepted the problems.

There are decent properties at every $$ level, so don't settle for crappy. At this point, you have withheld at least a month's rent, so you should be set to move to your next place. You should have been looking all month up to now and have identified something decent.

I'll say it again -- move out now and sue for damages after you have identified all of your damages, or wait to see if the LL sues you for breach of lease (sounds very unlikely that LL will). No need to discuss this further, just GO!
