First of all I can't imagine there not being some kind of code, law or even health dept. regulations that does not require landlords to maintain habitability with their rentals.

I am not argueing the point of who is responsible for the water bill or why tenants havn't noticed the leak and who is responsible for that. Only giving information regarding what "as is" means and when it applies. And if you want to argue that point, then I may as well take it a step further in this case. Tenant rented the unit as is, and at the time as is had working pipes with no leaks.
